Frequently Asked Questions

How long does a public body have to respond to my FOI request?

By law, they have 20 working days to respond in full or explain why they are refusing. This is usually around 4 weeks. If they miss the deadline, you can complain to the ICO.

Can they refuse my FOI request?

They can only refuse if the information falls under specific exemptions (e.g. national security, personal privacy, commercial confidentiality). However, they must explain which exemption applies and why.

What is the difference between FOI and a data access request?

FOI is for any information held by a public body. A data access request (under GDPR) is specifically for personal data about you. You can make both requests to the same organisation.

What do I do if they refuse or don't respond in time?

You can complain to the ICO for free. The ICO will investigate and can order the public body to release the information or explain their refusal properly.

Can I appeal the ICO's decision?

Yes, you can appeal to the First-tier Tribunal (Information Rights). The tribunal is independent and can overturn the ICO's decision if you have good grounds.
